Terms of Service

1. Agreement to Terms

By accessing or using the services of C3 Local Marketing, operated by L & M Creative Service INC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

C3 Local Marketing provides digital marketing services including Google Business Profile optimization, website design and development, Meta Ads management, Google Ads management, CRM and SMS automation, and local SEO services for home services contractors in California.

3. Service Agreement and Commitment

Monthly plans require a minimum 6-month commitment, which begins only after:

• Client reviews and approves all deliverables (website, GBP profile).
• A 30-day preview period at $0 is completed.
• Client signs the service agreement.

No commitment is required before seeing the finished work.

4. Ownership of Deliverables

Ownership of deliverables is determined as follows:

• Before month 6: Deliverables (website, domain, content) remain property of C3 Local Marketing.
• At month 6 completion: Client receives full, perpetual, royalty-free ownership of all deliverables — website design, copy, domain, and Google Business Profile.
• Domain registration is in the client’s name from day 1 for Presencia Digital and higher plans.

5. Payment Terms

• Monthly services are billed on the same date each month.
• A 3% credit card processing fee applies to card payments.
• Ad spend (Google Ads, Meta Ads) is paid directly by client to Google or Meta — not through C3 Local Marketing.
• Late payments may result in service suspension after 5 business days notice.

6. Cancellation Policy

Cancellation before the end of month 6 results in forfeiture of deliverables. Cancellation after month 6 requires 30 days written notice. Upon proper cancellation after month 6, all deliverables transfer to client ownership permanently.

8. No Guarantee of Results

While we are committed to delivering high-quality digital marketing services, C3 Local Marketing does not guarantee specific search rankings, revenue increases, or number of leads. Digital marketing results depend on many factors outside our control, including competition, market conditions, and algorithm changes.

9. Intellectual Property

The C3 Studio system, proprietary processes, templates, and methodologies remain the intellectual property of C3 Local Marketing. Client-specific content (photos, business information, testimonials) remains the property of the client at all times.

10. Limitation of Liability

C3 Local Marketing’s liability is limited to the monthly fees paid in the 3 months prior to any claim. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow limitation of liability — in those cases, liability is limited to the maximum extent permitted by law.

11. Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in Santa Barbara County, California.
